Justice Jerod Tufte, above, presented August 27 to the Big Muddy Bar Association on how the North Dakota Supreme Court views artificial intelligence in legal practice, and how the Court uses it in its own work. The session discussed City of Dickinson v. Helgeson, 2026 ND 34, in which a unanimous Court sanctioned a self-represented filer $500 for citing five fictitious cases, while stating that it does "encourage and embrace the use of technology to improve the work product of all litigants" subject to "careful use and scrupulous verification." He also discussed Administrative Order 36, effective May 18, 2026, which authorizes the court system's own use of generative AI, within limits tied to a tool's data-retention terms and the sensitivity of the information shared with the tool.
